They run true to size so if you normally wear a small get a small

They can be worn at the waist, but they are longer than I anticipated. They are very comfortable and come down to just above my ankles

They are nice, just remember they are womens not juniors, I made that mistake they were just a little to big in womens size

Usually a medium and both that and the large tighter on hips than prefer. Hips 41 waist 28 would xl make a difference in hips?

Your measurements are similar to mine except I'm a little larger in the waist. I bought a L and they fit fine through the hips (and even in the waist). You should be fine with a L.
