No the power function and track do not come with train.

Does this work with older 9v lego trains?

If you’re asking if this will run on the older 9v metal tracks, the answer is yes but you’ll need to retrofit the locomotive with a 9v motor. This set does not come with a motor or controller.

Is this a brand new box and never opened?

This set is now discontinued. Anyone selling it here is 3rd party seller. New or used depends on who the seller is.
