Q: the obvious question not answered, is how can bag work when it is above the outflow of urine??

The pockets hold nephrostomy drain bags. These drain the kidneys which are superior to bag/pockets. Gravity works fine with these shorts. Not sure a foley drain would work with these shorts.

Q: Do i go on the suitable waistline size my husband is a 40" waist? And are these made to wash over and over do they shrink?

I am not sure, bought for someone with exterior back drain. But there is another product called CathWear that is on Amazon that specifically mentions the Supra. It is much more $49.99 for 1. But looks like it is well made and stretch. I would try the 2 pack. Easy to return. I know I have did my own alterations on many clothing items to make medical devices work and more comfortable. Hope this helps.
